Cancellation policy

Consumers (§ 13 BGB, German Civil Code) have the following statutory right of withdrawal for contracts they conclude with us via the website, by email or by other means without simultaneous physical presence (distance contracts). Businesses (§ 14 BGB) have no right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Hostgarten – Webhosting & Webdesign, Proprietor: Georgios Tassoúlas, Heilbronner Strasse 1, 10779 Berlin, telephone: +49 (0)30 367 469 74, email: info@hostgarten.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You may also declare your withdrawal via the withdrawal function on our website at www.hostgarten.de/en/vertrag-widerrufen (“Withdraw from contract here”). If you use this option, we will send you an acknowledgement of receipt of such a withdrawal, stating the date and time, without delay (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive the notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount which corresponds to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, in comparison with the full scope of the services provided for in the contract.

Early expiry of the right of withdrawal

In the case of a contract for the provision of services, the right of withdrawal expires when we have fully provided the service and only began performance after you gave your express consent and at the same time confirmed your knowledge that you will lose your right of withdrawal once we have fully performed the contract (§ 356(4) BGB).

In the case of a contract for the supply of digital content not supplied on a tangible medium, the right of withdrawal expires when we have begun performance of the contract after you have expressly consented to our beginning performance before the end of the withdrawal period, you have confirmed your knowledge that by giving your consent you lose your right of withdrawal once performance begins, and we have provided you with a confirmation of the contract on a durable medium (§ 356(5) BGB).

Explanations regarding our services

• Web hosting and email mailboxes are continuing services. If you requested immediate activation and withdraw within the period, we only charge the proportion for the days up to your withdrawal; we refund the remainder.
• Domains are registered with binding effect for the first registration period upon registration with the registry (for “.de”, DENIC eG); this cannot be undone. If you requested immediate registration, the compensation for value in the event of withdrawal therefore generally corresponds to the fee for the first registration period. The domain remains registered in your name; on request, we will provide you with the auth code for a transfer.
• Web design: If, at your express request, we begin work before the withdrawal period has expired, in the event of withdrawal you owe compensation for the value of the services provided up to that point (e.g. drafts, programming) in proportion to the agreed total scope.
